Michelle Mishoe Miller is an experienced attorney with more than a decade of experience as a trial lawyer. Her practice is concentrated on labor and employment law. She has extensive experience representing clients in litigation as well as in all aspects of governmental administrative hearings and investigations. She has successfully represented clients before the Equal Employment Opportunity Commission, the Texas Workforce Commission, the National Merit Systems Protection Board and the National Labor Relations Board.

Ms. Miller represents individuals and employers in discrimination matters; wage and hour lawsuits; collective action cases, qui tam lawsuits, breach of contract issues, and any other type of legal matter involving wrongful termination or pertaining to the employment relationship. Her practice focuses on cases which arise under Title VII of the Civil Rights Act, the ADA, the ADAAA, the FLSA, the ADEA, the FMLA, the TCHRA, OSHA retaliation statutes, the Sarbanes-Oxley Act, Qui Tam laws, Sabine Pilot and all other statutory and common law causes of action which involve employer-employee relationships. This includes claims involving trade secrets, non-compete agreements, severance agreements, workers’ compensation retaliation, whistle-blower claims, defamation and others.

She has particular knowledge with respect to employment matters affecting highly compensated executives and is well versed in drafting and reviewing employment agreements. Her experience with regard to employment matters involving health care workers, day laborers and funeral directors is also extensive.

Ms. Miller counsels corporate clients on compliance and risks and advises clients on internal processes in order to strengthen employment relationships, minimize legal exposure and optimize working conditions. Her corporate work involves developing and drafting employment manuals, employment agreements and general employment forms for corporate clients; training and developing seminars for corporate clients and lecturing Human Resources professionals on employment law matters.

She has a demonstrated background in all aspects of trial, pretrial and post-trial work and as a former Assistant District Attorney for Harris County, TX, she has a unique background in trials, settlement negotiations and internal governmental processes.

Ms. Miller also successfully handles cases on appeal before the U.S. Court of Appeals for the 5th Circuit, such as Goudeau v. NOV, 793 F.3d 470 (5th Cir. 2015), which clarified the “stray remarks” standard for discrimination cases.
